Asylum Decision Tech Stack Lacks Legal Safeguards, Court Rulings Reveal

Two federal court rulings this spring showed how a chain of software vendors, biometric databases, and device-extraction tools operate without meaningful legal safeguards behind asylum denials.

A federal appeals court on April 24, 2026, blocked President Donald Trump's executive order suspending asylum access at the southern border, The Baltimore Sun reported, affirming a lower-court decision that the president cannot use an executive proclamation to override asylum protections enshrined in the Immigration and Nationality Act. The ruling was a direct rebuke to what the Associated Press described as a cornerstone of the Republican president's immigration agenda. But the legal fight over the asylum ban also illuminated something broader: the quiet assembly of a technological infrastructure that already determines who gets to ask for protection and whose data is fed into enforcement pipelines before any court ever hears their name.

That infrastructure, what researchers and civil-liberties advocates have begun calling the asylum-decision stack, now spans at least four distinct vendor-supplied layers. The CBP One mobile application collects biometric and geolocation data from tens of thousands of asylum seekers. A facial-recognition tool called Mobile Fortify, built by the Japanese electronics firm NEC, allows Immigration and Customs Enforcement officers to run identity checks in the field. Digital-forensics hardware from the Israeli company Cellebrite extracts the contents of seized phones. And at the analytical layer, platforms from Palantir and other data-integration firms knit those inputs into investigative leads and enforcement actions. The appeals court ruling addressed the legal question of whether a president can suspend asylum by fiat. It did not address whether the underlying machinery produces accurate, lawful, or rights-respecting outcomes.

Three weeks before the appeals court ruling, a federal judge in Boston reached a related conclusion about a different piece of the stack. On April 1, 2026, NPR reported, Judge Indira Talwani ruled that the Department of Homeland Security had illegally terminated the immigration status of nearly 900,000 migrants who entered the country through the Biden-era CBP One parole program. The ruling reinstated their status and exposed a core vulnerability in the way the federal government has tied immigration processing to a single proprietary software interface. When the app's legal framework shifted, the data and the legal standing of hundreds of thousands of people shifted with it.

The CBP One app is the digital front door of the asylum-decision stack. Introduced during the Biden administration as a scheduling tool, it quickly became the required point of entry for migrants seeking to present themselves at ports of entry. To use it, applicants submit facial photographs, passport or identity document scans, and real-time geolocation data. The app also collects device identifiers and usage metadata. From a design standpoint, CBP One functions as a consent gate: users click "I agree" before they can submit any information. From a privacy standpoint, consent in this context means little. There is no meaningful alternative to the app if someone wishes to pursue a lawful asylum claim at a designated port. The choice is to hand over biometric and location data or to be excluded from the process entirely.

That data does not stay inside CBP One. It feeds into the broader DHS data ecosystem, where it can be cross-referenced with other databases, including those maintained by ICE's Enforcement and Removal Operations. When the Trump administration moved to terminate the parole status of those 900,000 individuals, it did so based on records tied directly to the app they had been required to use. The Boston ruling made clear that DHS cannot unilaterally revoke a status that was granted through a lawful process, but the ruling did not order the deletion of the biometric and biographic data accumulated through that process. That data remains in government systems, available for future enforcement use regardless of the legal outcome.

Once a person is inside the United States, whether through parole, a pending asylum claim, or irregular entry, the next layer of the stack activates. Mobile Fortify, the facial-recognition application used by ICE and Customs and Border Protection, was designed for one purpose and has been deployed for another. According to a Wired investigation by Dell Cameron and Maddy Varner published February 5, 2026, the app has been used more than 100,000 times to identify immigrants and U.S. citizens alike. It was not originally built for field identification of unknown individuals, and it received operational approval only after DHS abandoned its own privacy compliance rules.

The company behind the software is NEC, which Wired identified in a January 28, 2026 report after DHS published new details about the procurement. The system allows an agent to hold up a phone, capture a face, and run it against a gallery of images drawn from DHS databases, including photographs taken during the CBP One registration process, prior encounters at the border, and driver's license databases. The accuracy problems are well documented. Face-recognition systems have consistently higher error rates for people with darker skin tones, and the National Institute of Standards and Technology has flagged demographic differentials in matching algorithms for years. When an ICE agent scans a face on a street corner and gets a match, the system does not disclose its confidence interval. The person being scanned has no way to know what database their face was matched against, whether the match is correct, or whether their photograph was lawfully retained.

The third layer of the stack extends from the person's own device. FedScoop reported on May 11, 2026 that ICE and Homeland Security Investigations plan to spend up to $100 million over five years on digital-forensics hardware and software from Cellebrite, the Israeli firm whose tools are widely used by law enforcement agencies to bypass device encryption and extract call logs, messages, contacts, photographs, and location histories from seized smartphones. For an asylum seeker whose phone is confiscated during processing or enforcement, the extraction yields a complete digital biography: the route taken to reach the border, the contacts saved in the phone, the messaging history with family members in the country of origin, the photographs that might corroborate or contradict a claim of persecution.

Cellebrite's tools have been controversial in criminal justice contexts for years. Researchers at the University of Toronto's Citizen Lab have documented vulnerabilities and the risk of evidence tampering. But the use of device extraction in the immigration context raises a distinct set of questions, because the person surrendering the device is not necessarily a criminal suspect. An asylum seeker presenting at a port of entry is exercising a legal right under domestic and international law. The seizure and extraction of their phone transforms a rights claim into a surveillance target before any individualised suspicion of wrongdoing has been established.

That transformation is not accidental. The data extracted by Cellebrite tools and collected by CBP One and Mobile Fortify flows into platforms that aggregate and analyse it for investigative leads. The most prominent of these is Palantir, whose role in immigration enforcement drew fresh congressional scrutiny in April 2026. Caroline Haskins reported for Wired on April 16 that Democratic lawmakers were demanding answers about Palantir and other surveillance firms powering the Trump administration's hard-line immigration enforcement agenda. Palantir's software ingests data from multiple DHS systems, including the biometric and biographic records collected at the border, and produces the analytical outputs that guide enforcement priorities.

The architecture is the story. An asylum seeker downloads CBP One because there is no alternative. Their face, fingerprints, location, and device metadata enter the DHS data ecosystem. If they cross the border irregularly or are encountered by ICE in the interior, their face is scanned with Mobile Fortify and matched against that same ecosystem. If their phone is seized, Cellebrite extracts its contents and those contents enter Palantir's analytical environment. At no point in this chain is there a clear mechanism for contesting the accuracy of a match, the lawfulness of a data retention, or the downstream consequences of an error. Each layer was procured separately, overseen by different DHS components, with different privacy assessments and different rules.

What the two federal court rulings in April 2026 share is a recognition that legal process cannot simply be replaced by executive discretion. The appeals court that blocked the asylum ban was enforcing the Immigration and Nationality Act's clear text. The Boston judge who reinstated CBP One parolees was enforcing the Administrative Procedure Act's requirement that agencies cannot revoke benefits without due process. Neither ruling reached the technological questions. But both rulings operate at the front and back ends of the same system, a system whose intermediary layers remain largely unregulated.

The vendors involved have faced varying degrees of public accountability. NEC has issued statements defending the accuracy of its facial-recognition algorithms but has not addressed the operational gap between Mobile Fortify's designed purpose and its field deployment. Cellebrite has maintained that its tools are sold only to authorised law enforcement agencies for lawful investigative purposes, a framing that does not engage with the question of whether immigration enforcement, particularly against asylum seekers who have committed no crime, constitutes a legitimate investigative use. Palantir, whose co-founder Peter Thiel has been a prominent Trump supporter, has described its government work as a matter of national security necessity. None of these companies has published an assessment of the compounded civil-liberties impact when their tools operate in sequence.

Civil-liberties organisations have begun to map the data flows more systematically. The Electronic Frontier Foundation has filed multiple Freedom of Information Act requests seeking the privacy impact assessments and interagency data-sharing agreements that govern the movement of biometric data between CBP, ICE, and the vendors they contract with. NOYB, the European digital-rights organisation, has flagged the transatlantic implications of device extraction at the border, noting that many asylum seekers carry phones purchased in their countries of origin, and that data extracted by Cellebrite tools may include communications with relatives in Europe, creating jurisdiction-spanning privacy exposures that no single regulator can address.

The unanswered questions accumulate. What happens to the facial templates of the 900,000 CBP One users whose legal status has been reinstated but whose biometric data remains in DHS custody? How many of the 100,000 Mobile Fortify scans produced false matches, and what happened to the people those false matches identified? When Cellebrite extracts the contents of an asylum seeker's phone, are the extracted records treated as investigative material or as intelligence, and what is the retention policy for each category? What is the false-positive rate of the Palantir-generated leads that result in enforcement actions against individuals whose only legal violation is a pending asylum claim?

The apps, the scanners, the extractors, and the analytical platforms do not make policy. But they operationalise it. And when policy changes overnight, as it did when President Trump signed the asylum ban in January 2026 and again when his administration moved to terminate the CBP One parole program, the technology stack does not pause for judicial review. It keeps running. The data keeps flowing. The matches keep being made. The two April rulings reasserted that asylum law exists and that administrative procedure must be followed. Neither ruling addressed the machines that have already been built between those two legal propositions.

What readers can verify for themselves begins with the Privacy Act statements that accompany the CBP One app, published on the CBP website, and the Privacy Impact Assessments that DHS is required to conduct for each major technology system. The vendors, for now, are not.
