Accessibility Gap in New Input Methods Poses Legal Liability

Devices shipping today with eye-only or gesture-only interfaces will be in consumers' hands for years. If a court finds in 2028 that a headset's exclusive reliance on gaze-and-pinch navigation violates the ADA, the remedy will not be a firmware update. It will be a recall, a class-action settlement, or both. The companies most exposed are not the startups building BCIs for clinical populations, which already operate under FDA oversight and medical-device regulatory frameworks that bake accessibility into the approval process. The exposed companies are the consumer electronics giants selling millions of units of spatial computing hardware to a general audience, with accessibility treated as a settings-menu feature rather than an architectural requirement.

A useful checkpoint will be the next major version of visionOS and whatever Meta ships as Orion's consumer follow-up. If either platform makes an alternative input pathway a first-class, setup-accessible feature rather than a buried accessibility toggle, that will signal that the legal signal has been received. If they do not, the first plaintiff to be locked out of their own headset because they cannot complete the eye-tracking calibration will find no shortage of law firms ready to test the DOJ's reasoning in court.
